Liability Assessments


As critical, and often undertaken in association with an initial property survey, is needed to assess the obligations, rights and liabilities arising under the intended lease.

Whether for Landlords or, more usually, prospective Tenants, the objective is to provide opinion on which party to the lease may be liable for the identified defect(s), and for any actual or potential consequential damage.

The type of survey undertaken can be as detailed as the client requires / instructs, but clearly, accuracy of such an assessment will increase in line with the level of survey.

Doing so prior to lease commencement, can allow terms of specific obligations in a lease to be renegotiated, and it can identify what if any action needs to be taken, and by whom, to prevent future problems. It can also lead to or be otherwise linked with, preparation of a Record of Condition
