Access Issues


Some works for which provision is made under the Party Wall etc Act allow, subject to conditions, limited access onto land of adjoining owners. This aside, legal right to such access only exists, again subject to the agreement of limits and conditions, for the maintenance and repair of existing buildings.

Access for any other purpose can only be gained by agreement with the adjoining owner.

No general rights otherwise exist for over-sailing adjoining land. Where this may be required such as for scaffold, hoists, or particularly for cranes there is again need to negotiate specific agreement.
